Further information for landlords regarding Superstrike Vs Rodrigues (2013) Court of Appeal case

Following consultation with the Department for Communities and Local Government, my|deposits is now able to offer joint guidance with the other deposit protection schemes on the recent Superstrike vs Rodrigues ruling.

The guidance, agreed and offered by all tenancy deposit protection schemes, can be downloaded here.

Further information from the industry bodies

A separate joint briefing note that considers the wider implications on the Superstrike judgement has also been produced by leading landlord and letting agent representative organisations including the National Landlords Association (NLA).

This contains more information about the case and looks further at the possible exposure you may face in the wake of this decision.

A copy of this document can be viewed here, and again it is recommend that you read it if you are a landlord.

None of the schemes or industry bodies are able to offer legal advice and any informaiton above is not intended to be taken as such. We do however hope that the informaiton will offer some degree of clarity following the speculation which has occured in recent weeks. For more detailed information on how the case impacts your individual circumstance you should seek independent legal advice.
